A no win, no fee accident at work compensation claim is one where you use a certain type of solicitor. They will not charge you anything if they lose the case. This is great news for anyone who is not prepared to take a financial risk with a compensation claim. The other good news is that most solicitors do work on this basis.
Obviously the solicitor will want to do everything that they can to win the case. They will want to be paid and if they win the case they will ask you for some money. They will normally ask you for about 30% of the compensation that you win, which means that you will still get a good amount of money but they will get a reward for winning the case as well. It may mean that they will only be prepared to take on cases that they think they can win and so if you do not have lots of evidence in your favour, then you may find it harder to get a solicitor.
The no win no fee system is good for people who cannot afford a solicitor. There is very little legal aid offered in personal injury claims and so this is a way that everyone can afford to get the legal help that they need. It is a no risk way of doing things.
There are sometimes scare stories in the press about people who chose no win, no fee and then ended up spending more than their compensation on the solicitors fees. The thing to remember is that this does not happen often or you would hear about it more. Also it is wise to sign an agreement with the solicitor before they take on the case with regards to how much you will pay them. Most solicitors will ask you to do this and then there will be no nasty surprises.
